Welcome to Cavino. These Terms of Use (“Agreement”) constitute a legally binding agreement between you (“you” or “the user”) and the provider of the Cavino mobile application (“we” or “us”). Please read this Agreement carefully before using the Cavino app (“the App”).

By using the App, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

1. Description of Service

Cavino is a digital management tool designed specifically for wine enthusiasts. By capturing photos of wine bottles, the App identifies wines and retrieves relevant information, helping you build and manage a personal wine collection and tasting history. The App also provides auxiliary features such as data statistics and filtering.

2. User Conduct

When using the App, you agree not to:

• Violate any applicable laws, regulations, or public decency standards;
• Upload, capture, or process any content that is illegal, infringing, false, or offensive;
• Attempt to reverse-engineer, tamper with, or disrupt the App;
• Use the App for unauthorized commercial purposes;
• Conduct any operation that may compromise App security, server stability, or the user experience of others.

We reserve the right to restrict access or terminate usage in case of violations without any liability for compensation.

3. Subscriptions and Paid Services

Cavino offers auto-renewable subscription services based on Apple In-App Purchases, including "Monthly Subscription" and "Annual Subscription."

• Payment: Payment will be charged to your Apple ID account at the confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current period.
• Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Management: You can manage your subscriptions or turn off auto-renewal by going to your Apple Account Settings after purchase. Fees for the current subscription period are non-refundable.

4. Intellectual Property

All designs, illustrations, animations, interfaces, content, branding, and technical logic within the App are owned by us or licensed to us. You may not copy, modify, distribute, or use any part of the App for commercial purposes without our prior written consent.

5. Service Suspension and Changes

We reserve the right to suspend, discontinue, or modify any part of the App’s functionality for reasons including system maintenance, legal compliance, or technical upgrades. Where appropriate, we will endeavor to provide advance notice within the App.

6. Disclaimer

To the maximum extent permitted by law, we shall not be liable for:

• Inaccuracies in wine bottle image recognition or errors in retrieved wine information;
• Outages of third-party services (such as cloud storage providers, third-party image recognition APIs, etc.) or force majeure events;
• Functional anomalies caused by the user's device settings, network environment, or hardware limitations.
• Data Loss: Any loss of data resulting from the user's failure to perform backups (such as not enabling cloud synchronization) shall be the sole responsibility of the user.

7. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of your country or region of residence. In the event of a dispute, you agree to first attempt resolution through friendly negotiation. If negotiation fails, the matter may be submitted to a court of competent jurisdiction in your jurisdiction.

8. Updates to This Agreement

We may update this Agreement as required by law or as the App's functionality evolves. Any changes will be announced within the App. Continued use of the App after updates constitutes your acceptance of the revised terms.
